§ 1 Company details

The Certiget online service, available at www.certiget.pl and www.certiget.eu, is operated by Certiget sp. z o.o., with its registered office in Warsaw (02-972) at ul. Sarmacka 20a/14, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001060298, NIP 9512578741.

§ 2 General provisions

These Terms and Conditions set out the rules for using the Certiget service, including in particular:
a) rules for access to the catalog of certification bodies,
b) rules for presenting certification body profiles,
c) rules for submitting and publishing reviews,
d) rules for the provision by Certiget of additional services, where offered.

Using the Certiget Service means that the user has read and accepted these Terms and Conditions, to the extent required by applicable law.

Certiget reserves the right to amend these Terms and Conditions for important reasons, in particular related to:
a) the development or change of the Service functionalities,
b) changes to the scope of services offered,
c) changes in applicable laws.

Amendments to the Terms and Conditions take effect on the date they are published in the Service, unless the amended Terms and Conditions provide otherwise, provided that such amendments do not infringe users’ acquired rights.

§ 3 Description of the Service

Certiget is an independent information and comparison platform whose purpose is to facilitate users’ access to information about certification bodies, management systems and certification processes, and to support transparency and high standards in the management systems certification market. Certiget is not a certification body and does not conduct certification activities.

Within the Certiget Service, Certiget provides in particular the following basic services:

Catalog of certification bodies
Certiget maintains and develops a catalog of management system certification bodies, available in particular at certiget.pl and certiget.eu, enabling users to ознакомиться with information on the scope of activities of certification bodies, the standards offered, experience and contact details.

Certification body profiles
Certiget enables the presentation of certification body profiles in the catalog, including information on activities, certification scope, experience and contact details, on the terms set out in these Terms and Conditions and—where cooperation is established—in separate agreements.

User reviews
Certiget enables users to publish reviews regarding cooperation with certification bodies and to read reviews published by other users, in accordance with the rules set out in these Terms and Conditions.

Certiget may also provide additional services which are not part of the standard use of the Service, in particular:
a) intermediary services in collecting certification offers and preparing comparative summaries,
b) general informational consulting regarding certification and implementation processes,
c) marketing services related to the promotion of certificates and the activities of certification bodies,
d) training services, including the organization of trainings and webinars on management systems and ISO standards,
e) consulting and implementation services in the area of management systems—only within the scope and on the terms set out in separate agreements.

The services referred to in section 3:
a) are optional,
b) are provided on the basis of separate offers, terms and conditions, or agreements,
c) may be paid, in accordance with the terms specified in the documents referred to in item b).

Using the catalog of certification bodies, certification body profiles and user reviews does not require using the additional services referred to in section 3.

§ 4 Provision of information necessary to provide the Services

When using the Certiget Service, the user may be asked to provide certain information, where such information is necessary for the proper provision of a given service or functionality of the Service.

The scope of information provided depends on the type of service or functionality used and may include in particular:
a) data necessary to use contact forms or submit inquiries,
b) data required to submit a review or use interactive functionalities of the Service,
c) data necessary to use the additional services referred to in §3 section 3 of these Terms and Conditions.

Providing data is voluntary; however, failure to provide it may prevent the use of certain services or functionalities of the Service.

If the user uses additional services involving intermediary collection of offers or forwarding inquiries, the user is informed about the scope of data transfer to third parties, in particular certification bodies, and the transfer takes place only to the extent necessary to provide the given service.

Once the data referred to in section 4 are transferred, the recipient becomes an independent controller of the personal data and is responsible for further processing in accordance with applicable law.

Certiget shall not be liable for the manner in which third parties referred to in section 5 process personal data, to the extent exceeding the services provided directly by Certiget.

Detailed information on the processing of personal data, including legal bases, scope and user rights, is set out in the Privacy Policy available in the Service.

§ 5 Reviews on certification body profiles

Certiget enables users to publish reviews regarding cooperation with certification bodies presented in the catalog.

Reviews should:
a) relate to the user’s genuine experience,
b) be formulated in a reliable manner and in compliance with applicable law,
c) not contain offensive, unlawful, misleading content or content infringing the personal rights of third parties.

The author of a review is responsible for the content of the review and its compliance with the law.

Certiget, as an entity providing the technical infrastructure of the Service, is not the author of reviews and is not liable for their substantive content, subject to obligations arising from applicable law.

Publication and moderation of reviews
5. Reviews are published in the Service after being submitted by the user, subject to the possibility of verifying them for compliance with these Terms and Conditions and applicable law.
6. Certiget reserves the right to moderate reviews solely with respect to:
a) compliance with these Terms and Conditions,
b) compliance with applicable law,
c) elimination of spam, technically defective content, or content that is manifestly unlawful.
7. Moderation does not include interference with the substantive content of a review or the rating expressed by the author, except where the review violates applicable law or these Terms and Conditions.

Responses of certification bodies
8. Certification bodies with an active profile in the Service may publish public responses to posted reviews.
9. Responses referred to in section 8:
a) represent the position of the certification body,
b) do not affect the content or rating of the user’s review,
c) may not contain unlawful content or content infringing personal rights.
10. Certiget does not interfere with the content of certification bodies’ responses, subject to the moderation rules set out in sections 6–7.

Visibility of reviews
11. Certiget may differentiate the scope of functionalities related to presenting reviews depending on the status of the certification body profile, provided that:
a) such differentiation does not affect the authenticity or content of reviews,
b) it does not lead to modification of ratings given by users.

§ 6 Technical requirements for the provision of Services

Using the Certiget Service requires:
a) an end device enabling access to the Internet,
b) Internet access,
c) an up-to-date web browser supporting HTML5, CSS and JavaScript standards.

The user is obliged to use the Service in accordance with its intended purpose and to ensure, at their own expense, the technical conditions necessary for proper use of the Service.

Certiget makes reasonable efforts to ensure continuous and proper operation of the Service; however, it does not guarantee uninterrupted access to all functionalities.

Availability and technical works
4. Certiget reserves the right to:
a) temporarily limit the availability of the Service or selected functionalities,
b) carry out maintenance, technical or development works,
c) introduce changes to Service functionalities,
where justified by technical reasons, security or development of the Service.
5. Certiget may inform users about planned technical interruptions via announcements published in the Service, where the nature of the works allows it.

Security and technical liability
6. Certiget applies appropriate technical and organizational measures to ensure the security of the Service and protect data against unauthorized access, in accordance with applicable law and adopted information security standards.
7. Certiget shall not be liable for:
a) technical problems or limitations resulting from the user’s devices, software or ICT infrastructure,
b) lack of access to the Service caused by factors beyond Certiget’s control, in particular Internet failures, force majeure or unlawful interference by third parties.
8. The user is obliged not to undertake actions that could disrupt the operation of the Service, in particular by:
a) introducing malicious software into the Service,
b) attempting unauthorized access to the Service systems,
c) using the Service in a manner contrary to law or these Terms and Conditions.

§ 7 Use of the Service

Use of the Certiget Service is voluntary and possible within the scope of functionalities made available in the Service.

The user may use the Service in particular by:
a) browsing the catalog of certification bodies and informational and educational content,
b) viewing certification body profiles and user reviews,
c) using interactive functionalities, including contact forms or review forms,
d) using additional services referred to in §3 section 3 of these Terms and Conditions, if available.

Use of certain functionalities may require providing data, as described in §4.

Rules of use
4. The user is obliged to use the Service:
a) in accordance with applicable law,
b) in accordance with these Terms and Conditions,
c) with respect for the rights and personal rights of other users and third parties.
5. In particular, it is prohibited to:
a) post unlawful, misleading content or content infringing personal rights or rights of third parties,
b) use the Service for marketing, spam or promotional activities without Certiget’s prior consent,
c) undertake actions that may disrupt the operation of the Service or circumvent its security measures,
d) use the Service in a manner contrary to its intended purpose.
6. In the event of a breach of these Terms and Conditions or applicable law, Certiget may, in proportion to the nature of the breach, temporarily limit or block the user’s access to selected functionalities of the Service.

User’s liability
7. The user is responsible for actions taken in the Service and for content they post or transmit via the Service.
8. Information presented in the Service is of an informational and comparative nature and does not constitute an offer, recommendation or advice within the meaning of applicable law. Certiget shall not be liable for the consequences of decisions made by the user based on information available in the Service, in particular regarding the choice of a certification body or the use of additional services.

§ 8 Liability

The user bears all costs related to Internet access and the use of devices and software necessary to use the Service.

Certiget operates the Service as an information and comparison platform and makes reasonable efforts to ensure that information presented is reliable and up to date; however, it does not guarantee its completeness or currentness at all times.

Certiget shall not be liable for content posted in the Service by cooperating partners, in particular descriptions of activities, scopes of services, offer-related information or other materials provided by such entities.

Certiget shall not be liable for damages arising from the user’s use of the Service in a manner contrary to applicable law or these Terms and Conditions.

Certiget shall not be liable for content posted on third-party websites to which links may be available in the Service.

Certiget shall not be liable for damages caused by acts or omissions of Service users.

Certiget shall not be liable for unauthorized use by the user of third parties’ personal data.

Certiget shall not be liable for technical problems resulting from the user’s devices, software or ICT infrastructure.

Certiget does not guarantee uninterrupted availability of the Service and shall not be liable for disruptions caused by external factors, in particular Internet failures, force majeure or unlawful interference by third parties.

To the extent permitted by applicable law, Certiget’s liability towards the user is limited to actual damages caused by Certiget’s wilful misconduct.

§ 9 Complaints procedure

The user has the right to submit a complaint regarding the operation of the Service or services provided directly by Certiget.

Complaints may be submitted:
a) electronically to the e-mail address indicated in §1,
b) via the contact form available in the Service,
c) in writing to Certiget’s registered office address.

The complaint should include at least data enabling identification of the user, a description of the objections, and indication of the Service functionality or service concerned.

Certiget reviews the complaint within 14 days of receipt and informs the user of the outcome using the contact details provided in the complaint.

Complaints regarding services or content provided by third parties, including certification bodies, should be submitted directly to those entities.

Using the complaint procedure does not exclude or limit the user’s rights under applicable law.

§ 10 Newsletter

Certiget may provide a newsletter service consisting in sending information about the Service, management systems certification, educational content, industry events, and commercial information related to Certiget’s business activity.

Newsletter subscription is voluntary and for an indefinite period.

Subscribing to the newsletter requires providing an e-mail address and giving separate consent to receive information electronically.

The user may unsubscribe at any time via the unsubscribe link included in each message or by contacting Certiget.

Unsubscribing from the newsletter does not affect the ability to use other functionalities of the Service.

Personal data processed in connection with the newsletter service are processed in accordance with the Privacy Policy.

§ 11 Personal data protection

Certiget processes users’ personal data in accordance with applicable law, in particular the GDPR.

Detailed information on the principles of personal data processing is provided in the Privacy Policy available in the Service.

Using the Service means that the user has read the Privacy Policy; however, it does not constitute consent to the processing of personal data where separate consent is required by law.

Certiget applies appropriate technical and organizational measures to protect personal data, in accordance with applicable law and adopted information security standards.

§ 12 Rights and obligations of the Parties

Certiget undertakes to provide services in accordance with these Terms and Conditions and with due care.

The user undertakes to use the Service in accordance with applicable law, these Terms and Conditions, and good morals.

It is prohibited to publish unlawful content or content infringing personal rights, copyrights or other rights of third parties.

Use of the materials, content or graphic elements of the Service requires Certiget’s prior consent, unless applicable law provides otherwise.

§ 13 Final provisions

These Terms and Conditions are available free of charge in the Service in a form enabling their acquisition, reproduction and storage.

Certiget reserves the right to amend these Terms and Conditions in particular in the event of changes in applicable law, development of the Service functionalities or changes in the scope of services provided.

Amendments to the Terms and Conditions take effect on the date they are published in the Service, unless the amended Terms and Conditions provide otherwise.

Matters not regulated herein are governed by Polish law.

Disputes arising from the use of the Service shall be resolved by a competent court in accordance with applicable law.
