www.certiget.pl www.certiget.eu is an online service operated by Certiget sp. z o.o., located at ul. Sarmacka 20a/14, 02-972 Warsaw, NIP 9512578741, KRS 0001060298.

§ 2 General Provisions

The owner and administrator of the service www.certiget.pl www.certiget.eu, hereinafter referred to as the "Service," is Certiget sp. z o.o., based in Warsaw, ul. Sarmacka 20a/14, 02-972. The company is registered in the business register conducted by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register, NIP: 9512578741, REGON: 526478579. The Service is intended for individuals seeking information on the implementation and certification of management systems, especially obtaining offers from implementation, training, and certification companies. Users of the Service can use the database of certification bodies created and updated by Certiget, based on the certification market and cooperation with certification partners. Regardless of the Services provided, the Service presents informational content on implementations and certifications, which is available for free. Using the Services requires acceptance of the Regulations. By starting to use the Service, the User agrees to comply with its provisions. In case of violation of the Regulations, Certiget may refuse to provide Services. The Regulations are available on www.certiget.pl www.certiget.eu in a form that allows saving and reproducing at any time. The language used in relations with Users is Polish or English.

§ 3 Service Description

Agreement and its Terms: The subject of the agreement ("Agreement") concluded between Certiget and the User is the provision of Services. The Agreement is concluded by accepting the Regulations and is valid indefinitely. The Agreement or the Service can be terminated at any time.

Scope of Services Provided: The Service involves collecting information from users interested in receiving offers or comparative summaries of offers in the area of management system certification, system implementation, or available training on the market. This information is forwarded to the appropriate certification body, consulting or training company. The Service may also provide other services as described in the Regulations.

Types and Scope of Services:

Database (Search Engine) of Certification Bodies: Certiget provides a database (search engine) of certification bodies.

Publishing Reviews of Certification Bodies: The possibility of publishing reviews of certification bodies according to guidelines.

Offer Inquiries and Comparative Summaries of Offers: Directing offer inquiries to Certiget to obtain offers or comparative summaries of offers.

Access to a Guide on Implementation and Certification of Management Systems: Providing a guide on the implementation and certification of management systems.

Collaboration with Consulting and Training Companies: Access to verified consultants in relevant fields.

Additional Support and Services: Offering additional services such as paid meetings, outsourcing in obtaining offers, advertising campaigns, etc.

Database (Search Engine) of Certification Bodies:

Creating a General Database: The general registry database of certification bodies is systematically updated by Certiget. Information about the bodies is collected from their websites or registry data.

Profile Completion by Bodies: Companies with a purchased cooperation package can personalize their profile by adding detailed information about the services offered and specializations, accreditations otherwise remain as an entry created by Certiget.

Publishing Reviews of Certification Bodies:

Possibility to Publish Reviews: Users can publish reviews of certification bodies, contributing valuable feedback on service quality. Reviews must comply with the service regulations and guidelines for adding them.

Verification of Review Content: All reviews are verified for compliance with the Service standards. Certiget conducts random checks of submitted entries (regardless of the rating level) by contacting the author to thoroughly verify the review before publication.

Removal of Inappropriate Reviews: Reviews containing inappropriate content may be removed by Certiget.

Privacy and Contact: The email address provided when publishing a review is not disclosed and is used for contact by Certiget in case of doubts about the review's content.

Reporting Review Abuse: Users can report cases of review abuse.

Offer Inquiries and Comparative Summaries of Offers:

Analysis of User Needs: Certiget conducts an analysis of the user's needs based on offer inquiries and individual contact, such as by phone, video call, or traditional meeting. During the contact, necessary information for preparing the offer is determined. Certiget responds only to messages directed from the company domain to which the inquiry pertains. Messages from commercial email boxes such as @gmail.com, @wp.pl, @interia.pl are not answered or processed by Certiget.

Directing Offer Inquiries: Offer inquiries along with the necessary information to prepare an offer are directed to certification bodies or consulting and training companies, depending on the type of inquiry.

Comparative Summaries: In the comparative summary prepared by Certiget, there are offers that have been collected and classified for comparison. The number of currently available offers participating in the comparison depends on the service model and the current offer directed to Users.

Providing Additional Offers: Offers not included in the comparative summary but obtained are provided to the user outside the summary.

Access to a Guide on Implementation and Certification of Management Systems:

Offering Specialized Knowledge: Certiget offers users access to extensive specialized knowledge on implementing and certifying management systems, provided through a guide available on the Service's website.

Content of the Guide: The guide contains comprehensive information on various aspects of the certification process, from preparation, through the selection of the certification body, to maintaining and improving management systems.

Facilitating the Implementation Process: The guide is designed to facilitate users in implementing management systems by offering practical advice and tips.

Sponsored Articles: The guide also includes sponsored articles created by certification bodies and consulting/training companies, providing valuable industry information.

Collaboration with Consulting and Training Companies:

Recommended Consulting Companies: Certiget collaborates with selected consulting companies characterized by high competence and professionalism.

Requests for Implementation Support: If implementation support is needed, Certiget proposes an online or phone meeting with a selected consultant. The consultant's selection is tailored to the user's needs, considering location, industry specialization, experience, and scope of activity.

Recommendations and Selection of Consulting Company: Based on the analysis of needs and expectations, Certiget can recommend specific consulting companies that best meet the certification process requirements.

Transparency and Responsibility: Recommendations regarding consulting companies are given transparently, considering the user's best interest. The final decision on the choice of the implementation partner is at the user's discretion.

No Participation in Consulting and Training Agreements: Certiget does not participate in the conclusion or execution of consulting and training agreements between users and consulting and training companies.

Additional Support:

Certiget offers a variety of paid services aimed at companies and organizations seeking specialized support in the certification process and promoting their achievements.

Meetings with a Certification Specialist: Planned, paid consultation sessions with a certification specialist, including individual advice related to the certification process.

Outsourcing in Obtaining Certification Offers: The outsourcing service includes comprehensive support in obtaining certification offers – from preparing the official offer inquiry, selecting units, through negotiations, to the finalization of the agreement.

Advertising Campaigns Highlighting Certification Success: Assistance in creating and implementing advertising campaigns tailored to the user's needs and marketing goals, aimed at promoting certification achievements.

Conditions and Availability of Services: Detailed information on the conditions, scope, and prices of services is available upon request. Services are tailored to individual needs and user requirements.

§ 4 Certiget's Role in the Certification Agreement Process in the Context of a (Free) Offer Inquiry

No Participation in Certification Agreements: Certiget does not participate in the conclusion or execution of certification agreements between users and certification bodies.

Limiting the Role to Providing Information: Certiget's role is limited to providing information and preparing comparative summaries based on offer inquiries. In the context of the free service, Certiget does not take actions to assist in concluding an agreement with the selected certification body.

Independent Decisions by Users: The decision to choose a certification body and conclude a certification agreement remains with the users of the service, who make their choice based on the information and summaries provided by Certiget.

No Involvement in the Negotiation Process: Within the free service, Certiget does not participate in negotiations, setting agreement terms, or other actions related to the certification agreement process.

§ 5 Provision of Information Necessary for Preparing an Offer

Provision of Data: Within the service, Certiget provides companies (certification bodies, consulting, training) with data contained in the form and details necessary to prepare an offer. A user who does not agree to the provision of data should opt-out of the service.

Responsibility for Data after Provision: After providing the data, the certification body, consulting, training company becomes the data controller, including personal data. Certiget is not responsible for further processing of these data unless it processes them independently within its activity.

§ 6 Profiles of Certification Bodies

Creating a Database: The general registry database of certification bodies, created and regularly updated by Certiget, contains basic public information about companies.

Profile Completion by Certification Bodies: Companies with a purchased package can enhance their profile with additional information, which increases the profile's match to user needs.

Responsibility for Profile Content: Companies are responsible for the content posted in their profile. Certiget is not responsible for its accuracy, reliability, or compliance with the law.

Reviews in Certification Bodies' Profiles: The Service allows collecting reviews about certification bodies, regardless of having or not having a purchased package. Each profile is open to user reviews and is subject to the same verification rules.

§ 7 Reviews in Certification Bodies' Profiles

Review Content: Reviews published on the service should be true and not mislead other users.

User Responsibility for Published Reviews: By publishing a review, the user confirms they have read the regulations and agrees to comply with them, taking responsibility for the content.

Prohibited Content in Reviews: Prohibited are content that is unlawful, inciting hatred, promoting violence, discriminatory, racist, offensive, defamatory, obscene, pornographic, slanderous, false, misleading, technically harmful, advertising, or containing external links.

Language of Reviews: Reviews may be written only in the language of the corresponding language mode of the site.

Review Verification: All reviews are verified before publication for compliance with the regulations. Certiget conducts random checks of submitted entries (regardless of the rating level) by contacting the author to thoroughly verify the review before publication. Negative reviews are always subject to verification.

Refusal to Publish Non-compliant Reviews: Reviews not compliant with the regulations will not be published by Certiget.

Right to Not Publish Certain Reviews: Certiget reserves the right not to publish reviews that are unreadable, contain personal data, or are duplicated.

Review Publication Process: Reviews will be published after verification. The user's email address publishing the review is not disclosed, but its provision allows contact in case of doubts about the review content.

Right to Respond: The certification body has the right to respond to reviews; for this, a cooperation package is required.

§ 8 Cooperation with Certiget – Partner Certification Bodies

Definition of Partner Certification Bodies: Partner certification bodies within the Certiget Service are certification bodies that have established formal cooperation with Certiget to promote their certification services.

Cooperation Rules:

Cooperation is based on separate cooperation agreements concluded between Certiget and certification bodies.

The agreements specify the terms, scope of cooperation, rights and obligations of both parties, including the principles of promotion and presentation of the offer.

Professionalism and Ethics Standards: Both parties are obliged to comply with the highest standards of professionalism and professional ethics.

Benefits for Partner Certification Bodies: Partners gain access to a wider user base and increased visibility in the Certiget Service.

Lead Generation for Partner Certification Bodies: Certiget actively generates leads for its partners. Certiget does not encourage current partners' customers to verify the market by using the Certiget service, but such a lead may arise naturally.

Partner Certification Bodies' Obligations: Partners are obliged to provide services at a high level, in accordance with applicable standards and legal regulations, and to comply with professional ethics.

Monitoring and Evaluating Cooperation Quality: Certiget monitors the quality of cooperation with partners, including the services provided and compliance with requirements.

§ 9 Technical Conditions for Providing Services

Equipment and Software Requirements: Using the Certiget Service requires an end device (e.g., computer, tablet, smartphone) with Internet access and an HTML-supporting web browser.

Securing Internet Connection: Users should ensure the security of their Internet connection. It is recommended to use secure connections, such as VPN, especially when accessing the Service in public Wi-Fi networks.

Protection Against Digital Threats: Due to the risk of unauthorized data acquisition and modification, it is recommended to use up-to-date antivirus and identity protection software.

Software Updates: Regular software updates, including operating systems and browsers, are recommended to ensure security and compatibility with the Service.

Responsibility for Security: Certiget is not responsible for damages resulting from improper security of user devices and Internet connections.

Information on Service Updates: Certiget reserves the right to update and modify the Service. Significant changes affecting technical requirements will be communicated to users through the service or by email.

§ 10 Using the Service

Acceptance of Regulations: Using the Service implies acceptance of these Regulations. Users are required to familiarize themselves with its content and comply with the contained rules.

Truthfulness of Provided Data: Data provided by the user in the process of obtaining offers must be true and up-to-date. False data may result in an inadequate quote, which may involve additional charges by the certification body, e.g., related to the extension of the audit.

Refusal to Provide Service: Certiget has the right to refuse to provide the service of collecting and comparing offers if it considers the inquiry data an attempt to fraudulently obtain information about the certification market. Certiget may refuse to provide the service in the following cases: the company in the inquiry does not respond to phone contact, the message was sent from an email domain not belonging to the company, the provided information is laconic and insufficient to prepare an offer, or the company refuses to provide necessary information, the company does not exist or is inactive in the business register. In such situations, Certiget does not process the inquiry or ceases to provide the service.

User Responsibility for Data: The user is fully responsible for the consequences of providing incorrect or outdated data.

User Obligations:

Using the Service should not cause inconvenience to other users.

It is forbidden to publish content violating third-party rights, promoting hate, pornography, violence, or other illegal content.

Using false data or other people's data is prohibited.

Not using the Service for activities that threaten its security or operation.

§ 11 Liability

Internet Access Costs: The user bears all costs related to Internet access necessary to use the Service.

Responsibility for Partner Content: Certiget is not responsible for the content posted by partner certification bodies, including company descriptions, service scopes, or other information published in the Service.

Liability for Improper Use of the Service: Certiget is not responsible for damages resulting from the use of the Service by users in a manner inconsistent with the law or the Regulations.

Responsibility for Content on Third-Party Sites: Certiget is not responsible for content posted on websites in other domains, links to which may be contained in the Service and are not under Certiget's control.

Responsibility for User Actions: Certiget is not responsible for damages caused by user actions or omissions.

Use of Third-Party Data: Certiget is not responsible for unauthorized use of third-party personal data by the user.

Responsibility for User Devices and Software: Certiget is not responsible for technical problems resulting from the use of devices, operating systems, web browsers, or other software by the user.

Service Updates and Availability: Certiget strives to ensure the continuity and availability of the Service but is not responsible for interruptions or disruptions caused by external factors.

§ 12 Complaint Procedure

Submitting Complaints: Complaints regarding services provided by Certiget based on these Regulations can be submitted to the company's address, email: [email protected], or via the contact form available on the Service.

Complaints Handling by Certiget: Certiget is the entity responsible for resolving complaints related to services provided directly by the Service.

Complaints Regarding Partner Certification Bodies: Complaints about the inadequate fulfillment of an agreement by a partner certification body should be directed directly to the partner responsible for fulfilling the agreement.

Complaint Handling Timeframe: Certiget will make every effort to handle complaints promptly. A response to the complaint will be provided no later than 14 days from the date of receipt.

Communication of Complaint Decision: The decision regarding the complaint will be communicated to the user along with the justification to the email address provided by the user.

Possibility of Out-of-Court Dispute Resolution: Submitting a complaint does not limit the user's right to use out-of-court dispute resolution methods, including through the EU Online Dispute Resolution platform, available at: http://ec.europa.eu/consumers/odr/.

§ 13 Newsletter

The newsletter is a service provided by Certiget. The newsletter service involves sending information, including commercial information, to the email address provided by the user. Using the newsletter service is voluntary, indefinite, and free of charge. For the provision of the newsletter service to the user, Certiget collects the user's email address and the required legal consents. Unsubscribing from the newsletter service is possible at any time by clicking the link in each email received as part of the newsletter (in the footer of the mailing) or by sending an email to: [email protected].

§ 14 Personal Data Protection

Collecting and Processing Personal Data: Personal data provided by the user to the Certiget service in connection with using the Service are collected and processed in accordance with applicable laws, including the General Data Protection Regulation (GDPR). Personal data processing is carried out for purposes related to the provision of services offered by the Service, including enabling the use of the Service's features, handling inquiries and complaints, and for marketing purposes if the user has consented to it.

Privacy Policy: Detailed information on the processing of personal data, their protection, user rights, and ways of using them are specified in the Certiget Privacy Policy, which is a separate document publicly available on the Service's website.

Consent to Data Processing: By consenting to the processing of their personal data in connection with using the Service, the user confirms they have read the Privacy Policy and accept its terms.

Personal Data Security: Certiget commits to using appropriate technical and organizational measures to ensure the security of processed personal data and protect them from unauthorized access, alteration, disclosure, or destruction.

User Rights: The user has the right to access their data, correct, delete, restrict processing, data portability, object to personal data processing, and withdraw consent to data processing at any time.

Changes to the Privacy Policy: Certiget reserves the right to make changes to the Privacy Policy. Users will be informed of any changes in a way that allows them to review the new terms.

§ 15 Rights and Obligations of the Parties

Certiget's Obligations: Certiget commits to providing services in accordance with the Regulations and applicable laws, with particular emphasis on maintaining trade secrets in accordance with Article 11, item 4 of the Act of April 16, 1993, on Combating Unfair Competition (Journal of Laws of 1993 No. 47, item 211, as amended).

Service Continuity: Certiget will strive to ensure the continuous operation of the Service. Technical interruptions necessary for updates, error fixes, or maintenance may occur. In case of planned interruptions, users will be notified.

Using the Service Lawfully: The user is obliged to use the Service in a manner consistent with the law, good manners, respect for personal rights, and intellectual property rights.

Prohibition of Publishing Unlawful Content: Publishing unlawful content in the Service is prohibited.

Intellectual Property Protection: All names, logos, trademarks, and other designations in the Service are legally protected. Their use without authorization is prohibited.

Copyright Protection of Materials in the Service: The user is entitled to use the materials available in the Service only within the scope of personal use. Any other use of materials requires Certiget's consent.

§ 16 Final Provisions

Changes to the Regulations: The Regulations may be changed in the event of changes in law, Service functionality, service provider designation, or rules for using the Service. Changes are effective for the future and do not affect acquired rights or benefits performed before their introduction.

Dispute Resolution: Disputes arising from using the Service will be resolved by the competent common court unless the parties reach an amicable resolution.

Out-of-Court Dispute Resolution Methods: Detailed information on out-of-court dispute resolution methods is available on the websites of the Office of Competition and Consumer Protection and consumer advocates.

Available Out-of-Court Paths: The user has the right to use out-of-court methods for resolving complaints and claims, including consumer courts and mediation.

Free Assistance: The user can obtain free assistance in resolving disputes from consumer advocates and social organizations.

ODR Platform: The EU Online Dispute Resolution platform is available for amicable dispute resolution.
